HashMemo respects the intellectual property rights of others and desires to offer a platform and Services which contain no content that violates those rights. Our Terms of Service require that information posted by Members (photos, videos, audio, questions, answers, comments, and profiles) be accurate, lawful, and not in violation of the rights of third parties. To promote these objectives, HashMemo provides a process for submission of complaints concerning content posted by our Members. Our complaint policies and procedures are described and/or referenced in the sections that follow.
Please note that we reserve the right to disable access to or remove content, in our sole discretion, that we believe may infringe on the intellectual property rights of other or otherwise violate our Terms of Service. We may also make a good faith attempt to forward the written notification, including the complainant’s contact information, to the Member who posted the content and/or take other reasonable steps to notify our Members that HashMemo has received notice of an alleged violation of intellectual property rights or other content violation. It is also our policy, in appropriate circumstances and in our discretion, to disable and/or terminate the accounts of Members, or groups as the case may be, who infringe or repeatedly infringe on the rights of others or otherwise post unlawful content.
Any copyright infringement notice or counter-notice you submit must be truthful and must be submitted under penalty of perjury. A false notice or counter-notice may give rise to personal liability. You may therefore want to seek the advice of legal counsel before submitting a notice or a counter-notice.
Claims Regarding Copyright Infringement
Notice of Copyright Infringement. Pursuant to the Digital Millennium Copyright Act (17 U.S.C. § 512), HashMemo has implemented procedures for receiving written notification of claimed infringements. HashMemo has also designated an agent to receive notices of claimed copyright infringement. If you believe in good faith that your copyright has been infringed, you may complete and submit a Notice of Copyright Infringement form, which contains:
1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
2. A description of the copyrighted work that you claim has been infringed;
3. A description specifying the location on our service of the material that you claim is infringing;
4. Your email address and your mailing address and/or telephone number;
5. Include the following statement: “I have a good faith belief that use of the copyrighted materials described above as allegedly infringing is not authorized by the copyright owner, its agent, or the law.”
6. Include the following statement: “I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”
Please submit your notice to HASHMEMO Inc.’s Copyright Agent by filling out our Notice of Copyright Infringement form.
Counter-Notice. If you believe that a notice of copyright infringement has been improperly submitted against you, you may submit a Counter-Notice, pursuant to Sections 512(g)(2) and (3) of the Digital Millennium Copyright Act. To submit a Counter-Notice, please complete our Counter-Notice Regarding Claim of Copyright Infringement form. Your notice must contain:
1. A physical or electronic signature of the Registrant.
2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
4. Your name, address, and telephone number.
5. The following statement: “I consent to the jurisdiction of Federal District Court located in Delaware, and that I will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
6. The following statement: “I swear, under penalty of perjury, that I have a good faith belief that the affected material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.”
